Billing the Territorial Supplements of regulated activities corresponding to the year 2013 in the Autonomous Communities of Catalonia, La Rioja, Castilla La Mancha and Valencia

RDL 20/2012, of 13 July, on the measures required to guarantee budgetary stability and encouragement of competitiveness established that, in the case of electricity supply activities or installations on which the taxes of the Autonomous Communities are levied, the access toll would be included as a territorial supplement, which would have to be paid by the consumers of these Autonomous Communities.

Ministerial Order ETU/35/2017 [PDF] (*) was published on 26/01/2017 with the territorial supplements corresponding to some Autonomous Communities. In particular, in compliance with this ministerial order, customers will be billed in the access tolls for the autonomous community taxes related to regulated activities of the year 2013, in the Autonomous Communities of Catalonia, La Rioja, Castilla-La Mancha and Valencia.

The situation described above is specific to 2013 because it was subsequently modified by Act 24/2013 of the Electricity Sector.

Customers with a supply point in the Autonomous Communities mentioned above, with electricity supply contracts during the year 2013.

  • Regardless of the retailer with which the supply had been contracted.
  • Regardless of the contracted voltage level or tariff.

The contract might have been with a different Retailer during 2013. The 2013 Territorial Supplement will be billed by the current Retailer.

This does not apply to supply points with change of holder or which have been cancelled after 31 December, 2013.

The amounts to be billed will be calculated as the difference between the amount of the access toll included in the bills generated during the year 2013 and the new amount of these tolls, after the Territorial Supplement has been included. This amount is different in each Autonomous Community.

These amounts are calculated by the electricity distribution company at the supply point, transferred to the retailer (on the toll bill) and finally billed to the customer.

The billing period will start on 27 July, 2017 (6 months after the coming into effect of Ministerial Order ETU/35/2017 [PDF] (*) ), and it will appear on the bill as follows:

  • The resulting amounts of each consumer, excluding taxes, less than 2 will be billed in a single bill.
  • If the amount to be billed exceeds 2, this amount will be billed in 6 or 12 instalments for customers with two-monthly or monthly billing, respectively.
